Tom Cruise and Paramount have received a major legal green light — and it clears the runway for more Top Gun. A U.S. federal appeals court has officially shut down the long-running copyright lawsuit tied to Top Gun: Maverick, ruling that the blockbuster sequel did not infringe on the original source material.
Appeals Court Backs Paramount
More than three years after the lawsuit was first filed, a three-judge panel from the U.S. Court of Appeals for the Ninth Circuit upheld an earlier ruling in Paramount’s favour. The case was brought by the estate of journalist Ehud Yonay, whose 1983 article Top Guns inspired the original 1986 Top Gun.
In its decision, the court ruled that Top Gun: Maverick does not share substantial similarity with Yonay’s article in terms of protected expression — a key requirement to prove copyright infringement.

Yonay’s widow and son had argued that rights to Top Guns reverted to the family in 2020 under U.S. copyright law. They claimed Paramount and its partners — including Tom Cruise, producer Jerry Bruckheimer, and studio head David Ellison — had no legal standing to make Top Gun: Maverick, which went on to earn $1.5 billion worldwide.
