Delhi HC Urges Kapur Family To Settle Estate Dispute Through Mediation

The court suggested that instead of escalating tensions, the parties should consider mediation. Justice Pushkarna observed that every member of the family is navigating grief in their own way after Sunjay’s sudden death, and urged them to resolve the dispute respectfully.

The bench went a step further, reminding the family that they have been blessed with significant financial wealth and should ensure that “the blessing does not turn into a curse.” It also emphasized that the legacy built by the family patriarch should not become a reason for permanent division.

The Core of the Dispute

The case stems from a lawsuit filed by 80-year-old Rani Kapur, who has sought to declare the Rani Kapur Family Trust “null and void.” She has alleged that the trust — constituted in October 2017 in her name — was based on forged and fabricated documents.

In her plea, she has accused certain family members of committing a “systematic fraud” to transfer assets into the trust structure. She has also sought a permanent restraint on Priya Kapur and her grandchildren from acting in furtherance of the trust.

Last month, the High Court issued summons to Priya and other defendants. The bench has asked them to submit written responses before passing any further directions. Notably, the court declined to order a status quo on the estate at this stage, stating that it would first need replies from the defendants before making interim decisions.
