The dispute, already under intense scrutiny, has now entered a more serious phase as his children Samaira Kapur and Kiaan Kapur — from his marriage to actor Karisma Kapoor — have raised questions over electronic records linked to the execution of his contested will.
The siblings’ latest submissions have intensified the inheritance battle, bringing alleged call-location data and possible criminal liability into the spotlight.
Call Records at the Centre of the Controversy
According to sources familiar with the case, Samaira and Kiaan have pointed out multiple inconsistencies in the so-called “digital trail” submitted by Sunjay Kapur’s third wife, Priya Kapur, before the Delhi High Court.
The records in question reportedly suggest that Priya Kapur’s mobile phone was located in New Delhi on March 21, 2025 — the very day she claimed, via a sworn affidavit, that she was physically present in Gurugram during the execution of Sunjay Kapur’s will.
If authenticated and admitted as evidence, this contradiction could become a critical point in a case involving an estate estimated at ₹30,000 crore.

Legal experts say such inconsistencies are not taken lightly. Advocate Swapnil Kothari noted that courts tend to be extremely cautious when sworn statements conflict with electronic evidence.
“When an affidavit clashes with digital records, even a single unexplained inconsistency can prompt the court to re-examine the entire narrative,” he said, highlighting the potential implications for the case.
Allegations Against the Will
This is not the first time the will’s authenticity has been questioned. Earlier filings reportedly flagged spelling errors, incorrect pronoun usage for the testator, and internal inconsistencies within the document. Adding to this, Samaira and Kiaan have claimed that neither Sunjay nor Priya Kapur were in Gurugram on March 21, but were instead in Delhi — a claim they say is supported by electronic data.

In a significant escalation, the siblings are now seeking criminal action against Priya Kapur, according to an NDTV report. They have requested that Sections 338 and 340 of the Bharatiya Nyaya Samhita be invoked, alleging that the will was fabricated and unlawfully excludes them from their rightful inheritance.
