In a significant legal development just days before its planned theatrical rollout, the Kerala High Court has lifted the interim stay on the release of The Kerala Story 2: Goes Beyond.

The division bench comprising Justices SA Dharmadhikari and PV Balakrishnan stayed the earlier order that had paused the film’s release for 15 days. The move comes as a major relief for the film’s producers, who had approached the court challenging the temporary suspension.

What Led to the Legal Twist

The controversy began when a Single Judge bench had passed an interim order staying the film’s release for 15 days. The court had also directed that the producer’s revision petition be considered by the Chairperson of the Central Board of Film Certification (CBFC) within two weeks.

Challenging this decision, producer Vipul Amrutlal Shah filed writ appeals before the division bench.

An urgent hearing was conducted late Thursday evening, just hours after the interim stay was issued. Senior Advocates Elvin Peter and Neeraj Kishan Kaul appeared for the producers, while Advocates Maitreyi Hegde and Sreerag Shylan represented the petitioners who had challenged the film’s certification.

After hearing arguments from both sides, the bench reserved its verdict before ultimately lifting the stay.


What the Producers Argued

During the hearing, the producer’s legal team maintained that the film does not target or denigrate the state of Kerala or any religious community.

As reported by PTI, Vipul Shah’s appeal stated that the film seeks to portray a “social evil” rather than attack a particular group. His counsel also argued that withholding the release would cause severe financial damage, as the film was slated to open in around 1,500 theatres across India and over 300 screens overseas.

Senior Advocate Neeraj Kishan Kaul reportedly submitted that storytellers have the creative freedom to address social issues in cinema, pointing out that courts have previously refrained from interfering in similar portrayals involving other communities.
